Court dismisses suit against soludo

The Awka Division of the Federal High Court, has dismissed the suit brought by a member of the House of Representatives, Okwudili Ezenwankwo challenging the nomination of Professor Chukwuna Soludo as the candidate of the All Progressives Grand Alliance (APGA), for the just contested Governorship election in Anambra State.

The Federal court Awka, presided over by His Lordship, Justice H. A. Nganjiwa has dismissed the suit NO: FHC/AWK/CA/43/2021 brought by Ezenwankwo and Others, seeking to nullify the primary election of APGA, held on June 23, 2021.

In the suit, Ezenwankwo had alleged that APGA did not conduct the Adhoc Delegates’ Congress to elect the delegates that would vote at the primary election. 

He also contended that the purported non conduct of the delegates’ election vitiated the nomination of Prof Charles Chukwuma Soludo as the candidate of APGA.

However, APGA through its team of lawyers led by P. I. N Ikwueto SAN, challenged the jurisdiction of the court to hear the matter on the grounds, that the suit was statute barred and that the complaint of the plaintiff border on the internal affairs of APGA which is non-justiciable.

Delivering its judgment, the court agreed with the submissions of counsel to the defendant (APGA), Ikwueto, SAN and held that the suit filed by the plaintiff was indeed statute-barred and liable for dismissal. 

The court further upheld the contention that the subject matter of the suit borders on the internal affairs of APGA, an issue that is non-justiciable and consequently dismissed the suit.
